on Release of Anna Nicole Smith Surgery Tape

A video documenting late glamour girl Anna Nicole Smith's breast
surgery will not be released into the public domain, a judge has ruled.
Superior Court Judge Mitchell L. Beckloff issued a temporary
restraining order which prevents the release of the 1994 videotape during
a hearing on Friday (03Aug07).
The injunction - which was granted at the request of Smith's former
attorney and executor of her will, Howard K. Stern - prevents the sale,
distribution or dissemination of the videotape, reports New York Daily
News.
In court documents, first obtained by CelebTV.com, Stern accused Texas
doctor Gerald Wayne Johnson of sending a tape showing the procedure to Los
Angeles-based memorabilia dealer Thomas Riccio.
Stern claims the surgery was taped without the former model's consent.
However, Johnson claims all procedures are recorded with the patient's
permission and are kept confidential "during the patient's
lifetime."
Johnson admitted he gave Riccio permission to use the video after Smith
died.
Smith, 39, died of an accidental drug overdose in a hotel in Florida in
February (07).
